This indemnity form, must be read and signed by each guest/group upon arrival.
By signing you agree and acknowledge that you have read and understood the
terms and conditions contained herein.
Indemnity / waiver / disclaimer
Thalassa's, 13 Stephen road, Southport (‘the Premises’)
Right of admission is reserved.
This indemnity applies to all persons who enter the Premises, whether as casual
visitor, overnight guest, user of any of the facilities on the Premises or participating in
any activity on the Premises or arranged by Thalassa's (collectively referred to as ‘the
Visitor’)
The Visitor acknowledges that he/she has read & understands this indemnity & agrees
to be bound by the following:
I/We enter and use the Premises, parking areas, surrounds, stairs on the Premises &
participate in any activities at the Premises entirely at my own risk.
I/We warrant that I have been advised of & am aware of & accept the I/we will be
exposed to a variety of risks & dangers at the Premises which have been explained
to me/us in detail & that I comprehend the risk & the implications thereof.
Such risks and activities include without limitation pools, ponds, stairs, recreational
areas, monkeys, wildlife and the use of gas cooking supplies/equipment.
I/We agree to obey at all times any warning notices and instructions & guest house
rules of Thalassa's.
The rules are as follows:
1. No fireworks are permitted – this is a firework free zone by law.
2. No parties or events such as stag nights or hen parties are permitted.
3. No fighting/violence is permitted or tolerated.
4. No loud music is permitted. Quiet time is from 9:30pm – 05:30 am
Visitors hold harmless and indemnify the owners, management, staff, directors of
Thalassa's and other guests (‘the Indemnified Parties’) against any consequences of
visiting, participating in any activities or incidents at or arranged by Thalassa's and
waive any claims they may have.
It includes any loss of/damage to personal effects/property, any indirect,
consequential or special loss/damage, financial loss, illness, injury, harm (as defined
in the CPA) or death howsoever caused & legal costs (attorney & own client scale) that
the Indemnified Parties may incur, unless such claim falls within the ambit of section
61 of the CPA (Act 68/2008)
I acknowledge that any assistance that the Indemnified Parties may render or arrange
is done without any admission or acknowledgement of fault or liability and as a show
of empathy & goodwill.
VISITOR LIABILITY - Damage. The Visitors/Guests is responsible for damages to the
Property that are above and beyond normal wear and tear caused by any member of
the guest group or person invited onto the property by a member of the guest group.
In the event that it is found that the property requires excessive cleaning, has missing
items, or incurred damage, management of Thalassa's shall notify Visitor/Guest of
such damages within 7 days of the check-out date and invoice Guest for replacement
or repair costs of missing or damaged items.
The guest agrees to pay such invoice within 10 days of receipt. Guest acknowledges
that unless Owner is notified on the day of check-in of any damage or cleaning
concerns, all such damages or concerns to the property during the occupancy will be
Guest’s responsibility, unless otherwise agreed on the day of notification.
